The Financial Crimes Enforcement Network ("FinCEN") Residential Real Estate Reporting Requirement, which took effect on March 1, 2026, has been delayed.

What Does This Mean For You?
Earlier this month, a district court in Texas vacated the reporting rule, holding that FinCEN exceeded its statutory authority.

In light of the decision, reporting persons are NOT currently required to file real estate reports with FinCEN and are NOT subject to liability if they fail to file reports while the current order remains in effect.  

What's Next?
FinCEN has the right to appeal this decision.

If an appeal is filed, the Department of Justice can apply for a stay pending the appeal. If this occurs, reporting obligations would be reinstated until the appeals court rules on the matter.
